4. Intellectual Property

All content on this site, including logos, images, and written material, is the property of Luna Baby or its content suppliers and is protected by intellectual property laws. Unauthorized use is prohibited.

5. Limitation of Liability

Luna Baby shall not be held liable for any indirect, incidental, or consequential damages arising from the use or inability to use our products or services.

These Terms of Service shall be governed by and interpreted in accordance with the laws of the State of Florida, United States.

 

📦 International Shipping & 📜 Terms of Service 

🌍 Origin and Processing

All products from Luna Baby are shipped directly from our store in Miami, FL – USA.
Orders are processed and dispatched within up to 5 business days after payment confirmation.
Made-to-order or special items may take up to 2 weeks to ship.


🚚 Shipping Options

We offer multiple international shipping options:

  • USPS (via SKY POSTAL / delivered by Correios in Brazil) – Estimated delivery: 15 to 25 business days

  • UPS / DHL – Estimated delivery: 10 business days

⚠️ Delivery times may be extended during high-demand seasons such as Christmas and New Year.


🧾 Customs Duties, Taxes & Import Regulations – Brazil

All international orders are subject to inspection and taxation by the Brazilian Federal Customs Authority (Receita Federal).
The customer is solely responsible for paying all applicable import duties and taxes.

As the buyer, you are considered the official importer of record, and responsible for complying with Brazilian import regulations. Charges may include:

  • Import Duty: 60% on the total purchase value (product + shipping)

  • ICMS (State Tax): Varies by destination state

  • Postal Fee: Charged by Correios for customs clearance

  • UPS / DHL: May charge their own administrative or clearance fees

⚠️ These charges are determined by Brazilian customs and can reach up to 92% of the total order value.

Receiving a previous order without being taxed does not guarantee future exemptions.

If the customer refuses or fails to pay the required fees, the shipment may be lost without refund.


📌 Luna Baby Store’s Responsibility

Luna Baby is responsible for your shipment until it reaches Brazilian customs.

From that point on, the customer is solely responsible for:

  • Monitoring customs clearance

  • Paying any taxes or import-related fees

  • Resolving delays, holds, or losses directly with Correios, UPS, or DHL

Important: Luna Baby does not offer compensation for delivery delays and is not liable for losses or issues after customs entry in Brazil.


📫 Order Tracking

Once your order ships, we will provide a valid tracking number.
It is the customer’s responsibility to track the shipment and respond promptly to customs or carrier notifications from Correios, UPS, DHL, or Receita Federal.


👤 Customer Responsibilities

  • 📍 Provide a complete and accurate shipping address

  • 🧾 Enter a valid CPF at checkout (required for customs processing in Brazil)

  • 💸 Pay all applicable duties, taxes, and clearance fees

  • 🔎 Regularly monitor the tracking and address any shipping or customs requests


🚨 Delays and Lost Shipments

A shipment is considered lost only after 90 days of no movement on tracking records.

Once the order enters Brazilian customs, Luna is no longer responsible for the outcome of the delivery.

  • Luna Baby does not offer compensation for delays, regardless of the cause.

  • Compensation is available only for confirmed losses that occur before the package reaches Brazilian customs, and are verified by the carrier.


📄 Invoices & Tax Documents

As Luna Baby is not a Brazilian company, we are unable to issue Nota Fiscal (NF-e).

Instead, we provide a commercial invoice including your CPF, which is accepted by Receita Federal as the official import document.

If taxes are due, Receita Federal will issue a DIS (Demonstrativo de Impostos e Serviços) in your name.
You will be responsible for completing the payment to release your order.


🛑 Final Sale Policy

All sales made on Luna Baby’s website are considered Final Sale.

  • We do not accept returns, exchanges, or cancellations, except in the case of a proven defective item.

  • By completing your purchase, you confirm that you accept and agree to all terms outlined above.
